'Transformers' hit lower orbit with $37.3M launch (AP)

LOS ANGELES ? Optimus Prime and his fellow Transformers are not quite over the moon with their latest box-office count.

According to distributor Paramount Pictures, "Transformers: Dark of the Moon" took in $37.3 million domestically in its first full day Wednesday. That's a 40 percent drop from its predecessor, "Revenge of the Fallen," which pulled in $62 million two years ago on opening day, which also was a Wednesday.

Adding in $5 million from debut screenings Tuesday night, "Dark of the Moon" raised its domestic haul to $42.3 million.

While that's well below the launch of "Revenge of the Fallen," the new "Transformers" sequel still is off to a healthy start. "Dark of the Moon" had the best single day for a movie this year, topping the previous high of $34.9 million on opening day for "Pirates of the Caribbean: On Stranger Tides."

The disparity between "Revenge of the Fallen" and the latest "Transformers" installment is even deeper considering 60 percent of revenues for "Dark of the Moon" came from pricier 3-D tickets. That means the audience was even smaller than for the 2-D "Revenge of the Fallen."

Admission prices also have risen since 2009, further widening the ticket gap between the two movies.

Based on an average movie price this year of $8.01 calculated by the National Association of Theatre Owners, "Dark of the Moon" sold about 4.7 million tickets in its first day. "Revenge of the Fallen" sold about 8.3 million on opening day, based on 2009's average ticket price of $7.50.

"Dark of the Moon" had the sixth-biggest opening day domestically among movies debuting on a Wednesday. Last year's "The Twilight Saga: Eclipse" had the best Wednesday debut at $68.5 million, followed by "Revenge of the Fallen."

Feds, defense spar over future of Bulger case (AP)

BOSTON ? Prosecutors and James "Whitey" Bulger's attorney sparred in court papers Wednesday about whether the government should be allowed to drop one of two pending federal cases against the former mob boss or whether those cases should be consolidated.

Bulger's attorney, Peter Krupp, said prosecutors are trying to shop for a judge by seeking to dismiss one indictment against Bulger in favor of a later indictment that accuses him of participating in 19 murders. He asked that the two indictments instead be consolidated.

In a response, U.S. Attorney Carmen Ortiz said that Krupp's motion carried no weight since Bulger has yet to be arraigned on either indictment. Ortiz said Krupp's motion is "without legal basis" and should be denied.

Krupp said prosecutors are attempting to manipulate the usual process of randomly assigning judges to cases by seeking to dismiss a 1994 indictment that charged Bulger with extortion and loan-sharking, but not murder.

"The government's apparent forum shopping is contrary to the public interest and undermines public confidence in the judicial process," Krupp wrote in his filing. He also said prosecutors are trying to "game the system."

But Ortiz said it is Krupp who is "forum shopping" for a judge, not federal prosecutors.

"In fact, the only logical explanation for the (defendant's) counter-intuitive strategy of opposing dismissal and requesting that he be prosecuted for additional offenses is that the defendant is engaging in forum shopping," Ortiz wrote.

Ortiz on Tuesday had moved to dismiss the 1994 indictment and focus solely on the 1999 indictment, which includes the murder allegations. If the dismissal is approved, U.S. District Judge Mark Wolf would be removed from the case. The 1999 indictment is assigned to Judge Richard Stearns.

Bulger, the former leader of the notorious Winter Hill Gang, was captured in Santa Monica, Calif., last week after 16 years on the run. He fled Boston just before the first indictment was made public in January 1995.

Krupp suggested that prosecutors are trying to avoid having Wolf preside over the case.

"Such forum shopping is disfavored," Krupp wrote.

Wolf has been a pivotal figure in the Bulger saga. He held a series of hearings in the 1990s that exposed the corrupt relationship between the Boston FBI and Bulger, who was an FBI informant who provided information on the Mafia, his gang's main rivals.

Former FBI Agent John J. Connolly Jr. was convicted of racketeering and obstruction of justice for protecting Bulger and his cohort, Stephen "The Rifleman" Flemmi from prosecution.

Krupp said that after "having encountered difficult questions" from Wolf during the 1990s hearings, the government obtained a new indictment ? the 1999 case ? rather than adding the charges to the 1994 indictment, "so that it might be assigned a different docket and drawn to a different judge."

In court documents filed Tuesday, Ortiz said prosecutors want to dismiss the earlier indictment because they consider the 1999 indictment the stronger case. Bulger faces life in prison if convicted on those charges.

Ortiz also cited the long wait the families of the murder victims have had to endure for authorities to find Bulger, now 81.

"The 19 families of murder victims have been denied justice for many years because the defendant has successfully eluded law enforcement apprehension," Ortiz said in court documents.

On Wednesday, Bulger was brought to the Boston federal courthouse from the Plymouth County Correctional Facility in Plymouth, where he has been held since Friday. The move was apparently so Bulger could meet with his lawyer.

Bulger is expected to be in court Thursday for two hearings: one on his request to get a taxpayer-funded attorney, the other on prosecutors' move to dismiss the earlier indictment.

Japan utility behind damaged nuke plant apologizes (AP)

TOKYO ? Executives at the Japanese utility behind the nuclear power plant sent into meltdown by the March quake apologized Tuesday to investors who repeatedly interrupted the annual meeting of shareholders with heckles, yells and outraged questions.

Tokyo Electric Power Co. Chairman Tsunehisa Katsumata promised that the company was doing its utmost to bring radiation leaks under control. He said it would speedily compensate people forced to evacuate the area around the Fukushima Dai-ichi plant and farms whose products were banned because of radiation contamination.

"All of us directors apologize deeply for the troubles and fears that the accident has caused," he said at a Tokyo hotel. "The entire group will work together to resolve this crisis as soon as possible."

But the meeting was punctuated by outbursts of emotion, as one by one, shareholders, their voices shaking, said the utility had ignored warnings about the dangers of nuclear power, the Fukushima Dai-ichi nuclear plant had been inadequately prepared for a tsunami, and the amount of radiation spewing into the air and water had not been fully disclosed.

One shareholder cried out that the executives should all jump into the reactor and die to take responsibility for the fiasco. Several others demanded they give up their entire pay. Another screamed that all they deserved was "seppuku," or ritual self-disembowelment.

The disaster at Fukushima Dai-ichi has erased about 90 percent of the value of TEPCO stock, once considered a safe investment, and stock owners are getting no dividends. It closed Tuesday up 0.3 percent at 317 yen.

Fuel rods have melted at three of the plant's reactors after a March 11 earthquake set off a tsunami that knocked out cooling systems, causing the world's worst nuclear crisis since Chernobyl. The quake and tsunami killed more than 23,000 people and damaged farms, ports and hundreds of suppliers of parts to the auto and electronics industries.

Leaking radiation forced the evacuation of thousands of residents, and the perilous struggle to contain the reactors is expected to continue into next year.

Despite the anger, many of those attending the meeting welcomed executives' remarks with enthusiastic applause.

They quickly defeated with a show of hands the first proposal from a shareholder, who demanded Katsumata be replaced in chairing the meeting by someone else, who could better address the nuclear crisis.

The top shareholders of the utility include Japanese financial institutions and the Tokyo metropolitan government.

Katsumata said management already had a majority of votes from those who had sent them in by writing or the Internet. That meant the company had no problems defeating a proposal from 402 shareholders that demanded TEPCO abandon nuclear power.

But the outrage from the public was clear by the frequent shouting. Reporters were not allowed to attend the meeting, which drew more than 9,300 people, about three times usual, but could watch the proceedings from a monitor at TEPCO headquarters. The meeting lasted six hours, about twice as long as a record long meeting a decade ago.

Although most of the executives' remarks were routine, addressing earnings and power supply, the shareholder who demanded a different chair, stressed that an apology and promises were not enough and said the whole world was suffering from the nuclear disaster. She did not give her name.

TEPCO President Masataka Shimizu, who has already announced his resignation to take responsibility for the disaster, told shareholders that the company was targeting mid-July to decrease the radiation leaks at Fukushima Dai-ichi under "step one," and to bring the leaks under control under "step two" in three to six months time after that.

The crisis has raised serious questions about the lax oversight of Japan's nuclear industry and prompted the country to scrap plans to rely on nuclear power for one half its electricity needs ? up from its current one third.

The utility has come under criticism as bungling and slow in responding to the crisis. Some of the data it disclosed about radiation leaks turned out to be erroneous, and it did not admit to a meltdown for weeks, raising suspicions about a lack of transparency.

Renewed safety fears have caused the government to shutter the Hamaoka nuclear plant in central Japan, a region where there is a 90 percent probability of a major earthquake in the next few decades.

TEPCO's losses for the fiscal year ended March 2011 totaled 1.25 trillion yen ($15 billion) ? one of the biggest annual losses ever in corporate Japan. TEPCO had a profit of nearly 134 billion yen the previous fiscal year.

Those results accounted for massive losses the utility booked from the disaster. But overall losses from the disaster are expected to be far bigger, including compensation for the thousands of people forced to evacuate from their homes around Fukushima Dai-ichi, and businesses such as farms that say products were damaged by radiation.

The company plans to sell assets to secure more than 600 billion yen ($7.4 billion) in funding but has acknowledged it likely faces more damage payments.

It reiterated that it was counting on some government aid.

Tattoo parlor owner linked with Ohio State scandal pleads guilty (Reuters)

COLUMBUS (Reuters) ? A tattoo parlor owner whose arrest on marijuana trafficking charges helped lead to the downfall of a top U.S. college football coach pleaded guilty on Tuesday in a federal court in Columbus, attorneys said.

During a search of the suburban Columbus home of the defendant, Edward Rife, local and federal agents discovered Ohio State University football memorabilia. While that memorabilia did not involve the drug charges, it did lead to an NCAA investigation.

Five players on OSU Coach Jim Tressel's 2010 team traded memorabilia, including championship rings and uniforms, for cash in violation of strict rules governing college sports.

Tressel, who was informed of the violations months before the case became publicly known and did not tell university officials, was given a five-game suspension, to match the punishment of the players. He quit last month.

Tuesday, Rife pleaded guilty to a count of conspiracy to distribute and to possess with intent to distribute more than 200 pounds of marijuana, as part of a plea bargain.

Assistant U.S. Attorney Kevin Kelley said there was no evidence any Ohio State players were involved in the marijuana operation. Rife's attorney, Stephen Palmer, said the memorabilia was the only link between Rife and OSU.

Lady Gaga sued over Japan earthquake charity bracelets (Reuters)

LOS ANGELES (Reuters) ? Pop superstar Lady Gaga has been sued over sales of her wristbands for Japan's earthquake relief efforts in a class action that claims that not all the proceeds went to victims as she had promised.

Michigan legal network 1800LAWFIRM also alleges that Gaga and other companies involved in the sale and marketing of the $5 white and red "We Pray for Japan" wristbands overcharged buyers on shipping costs and "artificially inflated reports of total donations".

"While we commend Lady Gaga for her philanthropic efforts, we want to ensure that claims that 'all proceeds will be donated to Japan's earthquake' are in fact true," said Alyson Oliver, an attorney for 1800LAWFIRM.

"Our intention via this lawsuit is to uncover any improprieties committed by Lady Gaga and appropriate the full donations assumed to the victims in Japan."

Lady Gaga, 25, and her representatives did not return calls for comment on Monday. The federal class action lawsuit was filed in Michigan on Friday while the "Born This Way" singer was in Japan for a benefit concert for victims of the March earthquake and tsunami.

Gaga, whose real name is Stefani Germanotta, is reported to have donated about $3 million to Japan disaster relief through sales of the wristbands and other ventures.

The official website for the singer's store however has several comments from frustrated fans complaining about long delivery times and shipping and handling costs of more than $5 for the small rubber wristbands.

The lawsuit claims that a slew of federal racketeering and consumer protection laws were broken by what it calls deceptive advertising and profits from the sale of the bracelets.

Lady Gaga was last month named the most powerful celebrity in the world by Forbes magazine, based on her earnings, media visibility and social media popularity.

Breast-cancer risk may be affected early in developmentThe last quarter of a century has taught science some newfangled things about breasts. For one thing, they appear to be showing up earlier in young girls, with possible consequences for breast cancer later on. For another, the way they grow and develop varies from woman to woman, and?if lab animals are any indication?normal exposures to commercial chemicals can alter that process. The growing human breast is also more vulnerable than we thought. Data from atomic-bomb survivors in Japan show that it was adolescents?not grown women?near the explosions who were most likely to develop breast cancer in later years. Since then, there's been similar data for girls who were exposed to medical X-rays or radiation therapy, as well as research showing that the pesticide DDT, now banned but pervasive in the 1950s and 1960s, is associated with a higher risk of breast cancer in women exposed as girls.

So it may come as a surprise that the federal agencies responsible for public health don't routinely take childhood exposures into account when testing whether commercial chemicals cause mammary tumors. In fact, in many lab-animal tests, they don't bother to look at the mammary gland at all. Breast cancer may be the No. 1 killer of middle-aged women in the United States, but as a new set of reports makes clear, the breast is a major blind spot in federal chemical-safety policy. "They just throw the mammary glands in the trash can," says Ruthann Rudel, research director with the nonprofit Silent Spring Institute and lead author of one of the papers, a review of the latest science on mammary gland development and toxic exposures.

The reports, published last week in the journal Environmental Health Perspectives, grew out of a 2009 workshop on mammary gland risk assessment, which involved scientists from federal and international agencies as well as independent groups. Breast cancer is just one of the areas federal agencies neglect, the reports show, along with health issues surrounding lactation and the timing of breast development in puberty. "Few chemicals coming into the marketplace are evaluated for these effects," state Rudel and her co-authors.

But blowing off these tests is a big mistake. The mammary gland?the breast's intricate milk-making structure?is uniquely sensitive to toxic chemicals, says Suzanne Fenton, a reproductive endocrinologist with the National Toxicology Program of the National Institutes of Health, and a co-author of the science review. In both rodents and humans, it starts to develop in the fetus, undergoes a colossal growth spurt at puberty, and doesn't fully develop until late pregnancy. During these times, its cells appear particularly vulnerable to carcinogens and other organ-altering substances. While lab rats and mice aren't perfect proxies for humans, their mammary glands undergo similar development patterns under similar hormonal influences, says Fenton.

When it comes to breast health, the reports fault the primary federal body responsible for regulating commercial chemicals, the U.S. Environmental Protection Agency, on several fronts. First, in its cancer tests that do assess mammary glands, lab animals are typically dosed with the chemicals in question as adults, past the sensitive age when toxins may cause critical damage to the organ. Second, in other tests that use younger animals, the mammary glands are not examined at all, meaning the tests could be missing signs of poor functioning and development. This is important because chemicals may affect both breastfeeding ability and the timing of puberty, which in turn influences breast-cancer risk. Finally, the EPA's testing protocols don't consistently examine the male mammary gland, which also appears to be sensitive to toxins.

These lapses come on top of the already lame reality that the EPA maintains toxicity data on just 1 percent of the 83,000 chemicals in use in this country. Most chemicals enter the market with no health testing at all. In 2009, the agency finally implemented a much-needed new program that screens chemicals for subtle effects on hormone systems. (Previously, the agency only checked to see whether chemicals caused more obvious problems, like tumors, sickness, or death.) Called the Endocrine Disruptor Screening Program, it has begun requiring manufacturers to test pesticides (and only pesticides, so far). These comprehensive tests look for widespread effects in rodent bodies, including on the brain, internal organs, and genitals?but not on mammary glands. Oops. "There are really no other major gaps [in those tests]," says Fenton.

It opens with a great educational section that breaks down EVERYTHING pertaining to outdoor grilling. From various meats, what each cut is good for.. how to prepare each cut (for all major meat types..seafood, beef, pork, poultry, and even veggies/fruits)....... spices (what works with what and why).... technical information on types of grills and ways to get the most performance out of your grill.

THEN it dives into the recipes. Each of the 300+ recipes is very well laid out with detailed instructions on how to use each type of grill (gas, charcoal, or open fire/smoker) including details like how to arrange coals, where to position meat, etc. It not only tells you how to prepare each dish, but explains in clear easy-to-understand language why things are done the way they are...often down to scientific levels discussion protein chains and whatnot. Very educational.

The recipes themselves are remarkably diverse.. they include gorgeous full color photos of many of the dishes. They have sections on beef, poultry, seafood, pork, veggies, desserts...etc.... plus a large section loaded with dozens of various rubs, marinades, brines,etc that are used within the book (always clearly referenced within a recipe).

Can't recommend it highly enough for everyone from the casual griller to even more hardcore folks.

I never grilled before, and really wanted to learn. By chance, I heard one of the authors on the WHYY radio show, A Chef's Table. What I heard from the author on that show impressed me, and so I got the book two days before July 4th.

This book is as thorough and consistent as an academic textbook. Recipes are detailed, consistently presented, and are appropriate for gas or charcoal grills. There are useful how-to's scattered throughout the book (such as "How to butterfly meat") that are invaluable to a novice like me.
At the start of the book is an expansive section on all the different cuts of meat and their properties, and the chemistry behind grilling.

Over the course of 3 days, I tried 10 of the recipes, and they were all huge hits. The burger recipes were amazing and especially simple to prepare. This book has a good mix of grilling 'staples', like burgers, wings, and steaks, as well as some great exotic dishes, such as vietnamese pork lettuce wraps and tandoori chicken.

This is the best cookbook I've ever bought. Do your guests a favor and pick up a copy!

Speculation coming from Cuba and Venezuela has focused on the possibility that Mr. Ch?vez has prostrate cancer, and has had his prostrate removed. A senior Venezuelan official didn?t respond to emailed questions about the speculation.

While at the same time,

his brother said the president would remain in a Cuban hospital for up to 12 more days

Fox News Latino, Associated Press, and others,

Some people suspect Ch?vez has been diagnosed with a life-threatening illness such as prostate or colon cancer while others claim doctors botched liposuction surgery and he suffered an infection.

Regardless of the diagnosis, the real cancer is the destruction of the Venezuelan economy, the people?s rights and freedoms under Chavez?s Bolivarian revolution, which he wants to metastasize through our hemisphere.

Judge Ciparick noted that the comments about Mr. Shiamili were ?unquestionably offensive and obnoxious,? but added that the site?s operators had ?not become ?content providers? by virtue of moving one of the comments to its own post.?

Chief Judge Jonathan Lippman, in a dissenting statement, struck a note of caution, suggesting that the Web site was more than ?a passive conduit of this defamatory material,? and adding, ?An interpretation that immunizes a business?s complicity in defaming a direct competitor takes us so far afield from the purpose of the CDA as to make it unrecognizable.?
